“Campaign The Promotion of Decent Work in the Fishing Sector”
Transnational dimension and jurisdiction challenges: fishing can happen within or outside territorial waters . Countries – referred to as coastal states* in these cases – exercise full sovereignty over the territorial sea or territorial waters , and sovereign rights for the purpose of managing fisheries resources within their Exclusive Economic Zones (EEZ*) , and can prohibit or authorize fishing vessels from fishing within these zones. International waters – referred to in international law as high seas* – are the remaining areas and represent 64 per cent of the ocean surface. In areas of the high seas, States have a duty to cooperate with each other. This is done mainly through the establishment of regional fisheries bodies or organizations*. The main responsibility of these regional fisheries organizations is to establish conservation and management measures to ensure the sustainable use of fisheries resources . Flag states* play a critical role as they must effectively exercise their jurisdiction and control over fishing vessels entitled to fly their flag to ensure they comply with international conservation and management measures and with national applicable labour standards and also ensure they respect human rights. More than 95 per cent of marine commercial fishing currently takes place within territorial waters

Several agencies and ministries related to decent work and forced labor in the fisheries sector include:
- Ministry of Maritime Affairs and Fisheries (MMAF): This ministry is responsible for regulating, supervising and developing the marine and fisheries sector in Indonesia. The Ministry of Maritime Affairs and Fisheries also plays a role in addressing the problem of forced labor and inappropriate working conditions in the fisheries sector.
- Ministry of Manpower (Kemnaker): The Ministry of Manpower is responsible for regulating and overseeing employment in Indonesia, including in the fisheries sector. This ministry has a role in addressing labor issues, including forced labor and improper working conditions.
- Ministry of Foreign Affairs (MoFA): The Ministry of Foreign Affairs cooperates with governments of other countries and international organizations to deal with issues of forced and decent work in the fisheries sector, especially those involving foreign fishermen and foreign fishing vessels.
- Ministry of Transportation (MoT): MoT is responsible for regulating and supervising sea transportation, including fishing vessels. This ministry is also working with the Ministry of Maritime Affairs and Fisheries and the Ministry of Manpower in overcoming the problems of forced and decent work in the fisheries sector.
- Labor Supervisory Agency (BP-TK): BP-TK is an institution tasked with supervising, controlling and enforcing labor regulations, including in the fisheries sector. BP-TK cooperates with related ministries and agencies in addressing the problem of forced labor and decent work.
- Ministry of Health (MoH): MoH is responsible for regulating and supervising occupational health and safety, including in the fisheries sector. The ministry also plays a role in overcoming the problem of forced labor and inadequate working conditions from a health and safety point of view.
In addition, local governments at the provincial and district/city levels also play a role in addressing issues of decent work and forced labor in the fisheries sector. They work closely with relevant ministries and agencies in overseeing and enforcing labor-related regulations in the fishing sector.
